Leon County Election Supervisor Alleges 'Breach of Contract' After Security Test Revealed Hackable Elections Possible on Diebold Optical-Scan Systems!

Ion Sancho is fighting back. Sancho, the Election Supervisor of Leon County, Florida who exposed a number of security flaws in Electronic Voting Machines made by the Diebold corporation of...

Ion Sancho is fighting back.

Sancho, the Election Supervisor of Leon County, Florida who exposed a number of security flaws in Electronic Voting Machines made by the Diebold corporation of North Canton, Ohio, today launched legal "breach of contract" proceedings against the company. The action has been filed on behalf of the Leon County Supervisor of Elections office.

In a conversation moments ago with Sancho, he confirmed to The BRAD BLOG that "we filed a breach action this morning, pursuant to a contract which notifies Diebold we are pursuing all available options."

The breach concerns Diebold's refusal to deliver their latest operating system for the optical scan voting systems which had previously been used in Leon County -- until Sancho discovered an alarming security flaw in the system at the end of last year.

"According to our contract with Diebold," Sancho explained, "we have to give them 30 days notice. And so we are requiring them to answer by March 21, as to how they intend to repair the breach."

The only two other Voting Machine Vendors, ES&S and Sequoia Voting Systems, have now officially refused to do business with Leon County and Sancho in the wake of a series of security evaluations held last year in the county on actual Diebold equipment. With the state threatening Sancho with legal action themselves if he is not able to implement a voting system which requires with the federal Help America Vote Act (HAVA), Sancho had been forced to attempt to do business again with Diebold.

The most infamous of the security evaluations held last year by Sancho was a "hack test" in December of Diebold's optical scan voting system. That mock election test revealed that election results could be completely flipped on Diebold's optical-scan system without a trace of the hack being left behind.

With all three companyies now refusing to do business with him, and pressure being applied from Diebold as well as state and local officials to do "do something about Sancho" - he now finds himself with no other choice but to fight back against Diebold, and face this "titanic clash" head on...

Sancho had exposed a flaw in the Electronic Voting Machine Company giant that has had earthquake-like repercussions across the entire electoral system in the United States, as The BRAD BLOG has been reporting in great detail for at least several months.

Now the Republicans in Florida, all the way up to Governor Jeb Bush's office, have taken notice of the situation and instead of lauding Sancho for his actions, have decided to bring political pressure to bear on the elected Sancho.

After the startling December 2005 "hack test", Sancho vowed he would would never use Diebold equipment in another Leon County election. The state's capitol, Tallahassee, happens to be in Leon County.

But Sancho's attempts to contract with another vendor have now all failed. Of the three vendors certified to sell election equipment in Florida -- Diebold, ES&S and Sequoia -- all three have now refused to do business with him.

At year's end, after the Diebold hack, ES&S had promised to deliver new equipment for Leon County -- only to leave a voice message just prior to the January 1, 2006 HAVA deadline for states and counties to sign new contracts for election systems upgrades to be paid for with federal funding. The ES&S representative informed Sancho the company would be unable to supply inventory to Leon County in time for the 2006 elections. Shortly thereafter, however, the company signed a contract to supply neighboring Volusia County with election hardware, and more recently, they informed the state of Maryland that they'd be able to supply machines to the entire state in time for this year's elections.

Sancho's third, and last, option was the Sequoia Voting Systems company. They too had promised to deliver a contract to Leon County. But as of last Thursday, the day after they had promised to deliver that contract, Sancho was informed that they would be unable to do so.

Sancho told The BRAD BLOG moments ago that the excuse he was given by Sequoia, after their sales rep had previous promised there would be no problems, was that Sequoia now says they "have no plans to sell anywhere in the United States. We're at capacity and we're not taking any new orders for 2006."

Apparently, Sancho says, the CEO of Sequoia overruled the local representative and Sancho is now left with none of the three certified Voting Machine Vendors willing to do business with him.

Despite that, as Susan Pynchon of Florida Fair Elections Coalition wrote in an email to Election Integrity Advocates earlier today, "two Republican members of Leon County's seven-member county commission blasted Sancho for failing to provide Leon County with accessible voting machines" in recent Leon County Commission meetings.

According to Pynchon, and confirmed in previous discussions The BRAD BLOG has had with Sancho, Diebold has been putting pressure on the state and the county to remove Sancho from office. As Pynchon wrote today:

 

At a Leon County Commission meeting on February 28, 2006, county staff revealed that Chuck Owen, Division Counsel for Diebold Election Systems, met with county staff behind closed doors on February 27. According to staff, Owen stated that "Diebold would sell its touch-screen voting machines to the county if, and only if, the county removed Supervisor Sancho from office."



The attacks have also now come from the office of Governor Jeb Bush's own Department of State. That, even though Sancho revealed for them a flaw in their own voting systems which would make Florida's vote unsecure and completely hackable. According to Pynchon:

 

Florida's Department of State, instead of supporting Sancho, has gone on the attack against him. The DOS demanded the return of $564,421 in Help America Vote Act funds from Leon County and, in a March 3 letter from Secretary of State Sue Cobb, threatened Supervisor Sancho with "legal action" if he does not have a disabled-accessible voting system in place by May 1, 2006. State law allows the governor to suspend an elected official and further allows the state Senate to remove an elected official from office.

The Tallahassee Democrat today reports a Cobb spokesperson as claiming "removal from office 'is not part of our thought process.'"

The attacks from the state have come even while the state of Florida itself, as we reported last Friday, sent a late-night "Technical Advisory" to every Election Supervisor in Florida warning them to take make "security enhancements" to avoid the type of election fraud revealed possible by Sancho's tests. The advisory, sent as the weekend was beginning at 4pm on Friday evening, was issued by the Director of Florida's Division of Elections, Dawn K. Roberts. She did not mention either Diebold or Sancho by name in the warning, nor did she refer to Sancho's hack of the optical-scan systems in Leon County.

"The thing that they don't want to admit," Sancho told us, "is that the Diebold breach [of contract] is in large measure due to that hack test."

"As an elected official of the voters of Leon County, I have the constitutional responsibility to do everything in my power to make sure the equipement is accurate and reliable," Sancho told us during a phone interview last weekend on all of these matters. "In fact I'd be negligent if I didn't do everything I could to establish their reliability," he said, especially in light of Diebold's "on-the-record admissions" of attempting to circumvent law and lie about facts in California and elsewhere around the country.

Those admissions in California in 2004 led to the decertification of Diebold touch-screen machines by California's former Secretary of State Kevin Shelley.

A recent report commissioned by the current SoS in California, Bruce McPherson, confirmed the findings of the Leon County Hack Test. Inexplicably, McPherson then went ahead and re-certified Diebold in the state nonetheless. One of the participants in that analysis, the Tallahassee Democrat reports, has sent a letter of support to Sancho, questioning what may be behind the attacks he is now receiving:

 

A report by California's Voting Systems Technology Assessment Advisory Board recently backed up Sancho's findings of problems with the Diebold system. One of the report's authors, David Wagner, e-mailed Sancho on Saturday to express support for him.

"I think very highly of your contributions, and I am puzzled why others fail to recognize just how much you have done for the voters of Florida," he wrote. "I find it unconscionable what some of the vendors seem to be doing to make life difficult for a supervisor of elections who would put the public interest first and foremost."

When asked whether the refusal by all three companies to do business with Sancho was due to collusion as punishment for exposing Diebold, or whether ES&S and Sequoia both feared their equipment would be submitted to the same rigorous testing the Diebold machines faced, Sancho would say only, "There's an old adage, Brad, where there's smoke there's fire."

He didn't wish to yet elaborate further.

"These are pretty incredible days," he told us. "There's a titanic clash now going on that's almost unfathomable. These are multi-billion dollar corporations that we've caught here and they don't like it," he explained, clearly exasperated by the situation he reluctantly finds himself in the middle of.

"I'm just a citizen," he went on, "and I've never seen or been involved in anything like this."

He vowed, however, to keep fighting -- for both his constituents who elected him to office, and against the powers-that-be who seem to have any number of reasons to take him down. All of those reasons would seem to be other than ensuring Florida's electoral integrity and transparency -- and for that matter, the electoral integrity and transparency of the world's once-greatest democracy.

GAO report highlights concerns with electronic voting security and reliability

The U.S. Government Accountability Office (GAO) today released a 101-page report on election security and reliability concerns.

In response to the release of that report, members of the House Committee on Government Reform issued a statement that highlighted the following problems:


Voting System Vulnerabilities Identified by GAO:
•Cast ballots, ballot definition files, memory cards, and audit logs could be modified.
•Supervisor functions were protected with weak or easily guessed passwords, and memory cards that allowed individuals access to voting machines were inadequately protected.
•Systems had easily picked locks and power switches that were exposed and unprotected.
•Voting machine vendors had weak security practices, including the failure to conduct background checks on programmers and system developers, and the failure to establish clear chain of custody procedures for handling software.


Voting System Failures Have Already Occurred During Elections
In addition to identifying potential vulnerabilities, GAO identified a number of cases of operational failures in real elections. These examples included:
•In California, a county presented voters with an incorrect electronic ballot, meaning they could not vote in certain races.
•In Pennsylvania, a county made a ballot error on an electronic voting system that resulted in the county’s undervote percentage reaching 80% in some precincts.
•In North Carolina, electronic voting machines continued to accept votes after their memories were full, causing over 4,000 votes to be lost.
•In Florida, a county reported that touch screens took up to an hour to activate and had to be activated sequentially, resulting in long delays.


Problems With Implementation of Voluntary Standards, Testing, and Federal Efforts to Improve Voting System Security
GAO reported that voluntary standards for electronic voting adopted in 2002 by the Federal Election Commission contain vague and incomplete security provisions, inadequate provisions for commercial products and networks, and inadequate documentation requirements. GAO also found that tests currently performed by independent testing authorities and state and local election officials do not adequately assess electronic voting system security and reliability.

The GAO report indicated that national initiatives to improve voting system security and reliability of electronic voting systems either lack specific plans for implementation or are not expected to be completed until after the 2006 election. According to GAO, “Until these efforts are completed, there is a risk that many state and local jurisdictions will rely on voting systems that were not developed, acquired, testing, operated, or managed in accordance with rigorous security and reliability standards — potentially affecting the reliability of future elections and voter confidence in the accuracy of the vote count.

The Election Assistance Commission, which was created as part of the “Help American Vote Act” began operations in January 2004. To improve the security and reliability of electronic voting systems, GAO recommends that EAC establish tasks, processes, and time frames for improving the federal voluntary voting system standards, testing capabilities, and management support available to state and local election officials. EAC commissioners agreed with GAO recommendations and stated that actions on each are either under way or intended. The National Institute of Standards’ (NIST) director also agreed with the report’s conclusions.

Congressional Redistricting – Gerrymandering

After a Superficial Study by a Site Participant Regarding Congressional Redistricting – Gerrymandering; inclusive of An Analysis of Incumbent Senators Virtual Stranglehold on campaign financing. [Whether from: Corporate Monopolies, other special moneyed interests and/or the wealth class through their lobbyists.]

Warranted Preliminary Concerns emerged.

Some Site Participants Suggested the potentiality unsettling question: Never in our republican-democracy‘s History has the unpleasant question been introduced: That most; or, at least a large majority of Congressional seats were gerrymandered redistricted to such an extent incumbents could never be defeated; even by vast amount a dissatisfied people. Could it be the Senate possesses a stranglehold on campaign financing – a monopoly - so it is virtual impossibility for voters to remove an Incumbent. Regardless, what polls report the public will to be?

An important third concern: is the electronic vote machine. Questionable: regarding reliability without a paper trail. Could elections effortlessly be subjected to large-scale fraud? Without a paper trail or ballot, voters we are compelled to trust the electronic voting-Machine corporations.

We make no accusation here. But, do sound the alarm bells that democracy may have or could be co-opted, undermined and elections effectively nullified by malefactors.

If so, then Government by the people by consent of the governed in America no longer exists. BLUNTLY, IS REPUBLICAN DEMOCRACY DEAD???

We ask visitors to be patient as we expand our study into this unexpected potential state of affairs. Inviting all to conduct their own research.

Father,
We pray, direct our decisions on this election day. Reveal Wisdom to cast our ballots in Virtue's way.
Guide us to the right thing - our dictates of conscience to follow. May we remain true to Justice - dedicated to our nation's ideals. Pursuing democracy's blessings, for all, not just benefiting ourselves. Grant goodwill to our hearts, in these times so troubled with turmoil. May no one shame our reputation; may our electorate set an example.

May our quest for the Reign of Peace, be broadcast throughout the world.

After campaigns so abrasively hard-fought; give us insight to know each citizen did their responsible part. Exiting the polls unified by one thought; all harsh words, like our sins, should be forgiven - all be forgot.

Never will divisions exist, strong enough, to divide this united nation. In opposition, never are we foes. Not enemies, rather citizen-friends. A giant family bonded forever as one, loving each other as Americans.

SEVERAL TECHNIQUES
TO FIX ELECTIONS
WITHOUT APPREHENSION*

[*Whilst Accusing The Suspicious As Paranoid Conspiracy Nuts]
*Of course, this is SATIRE. This could not happen in the U.S.A.
Do not attempt this, you might win.

FIXING ELECTIONS ... Let me count the ways


1. Presidential elections are fixed by fixing statewide elections. [Swing States]. Statewide elections are fixed by fixing county-wide elections. And, county-wide elections are fixed by fixing the vote total in every precinct.
2. No election can be fixed without the active participation of the County Supervisor of Elections. Who must be supported by amicable local powerbrokers.
3. Never fix an election by increasing your candidate's vote total, but by reducing his opponent's vote total. Bluntly, simply find some excuse not to tabulate a substantial portion of his legal votes.
4. Insist voters must vote in the precinct of their residence, if not their vote is not counted. Then, the day before, change to geographic location of their polling place in their precinct. They get confused lost frustrated quit and do not vote.
5. Do not send precinct workers to the right polling place.
6. Do not open the polling place on time; especially when voters are rushing to work.
7. Do not send enough voting machines and workers to large precincts; thereby creating long waiting lines. This frustrates people who get irritated bored and go home or to work. Meanwhile, overstock small precincts notorious for low turnout.
8. Always under-train precinct worker so they do not know how to cope with voting problems. Present them with a massive complicated reference book which no one could figure out except lawyers.
9. Tell precinct workers to make the voter feel stupid, or a bad citizen, if the voter has a question.
10. Unplug main computer when your opponents' favorable precinct transmitting their electronic vote results.
11. Blame all problems on computer glitches.
12. Any voter with a similar name on the Purge Felony Voter List will not be permitted to vote; except by provisional ballot.
3. Take forever to investigate and count all provisional ballots, if your candidates are winning.
14.Make sure your party has enough "observers" to challenge "suspicious voters" right to vote. Like minorities!
15. Have the sheriff post officers, with mirrored sunglasses, at your opponents' favorable precincts. Especially, minority precincts.
16. If your candidates begin to lose, the rule becomes intimidate and confuse.
17.Then there is the Ukrainian methodology. Simply invent numbers alleging your candidates won. The most evil but ingenious.
18. Simply fix the computer program codes so your party's candidates always win. Once code is fixed, you can never lose.
19. Never count absentee ballots, if your candidates are winning. Lose them in the county warehouse.
20. Always stuff the absentee ballot boxes, if your candidates are losing. Such as, informing the public you received requests for 50,000 absentees, when requests really were 5,000. This gives you a 45,000 blank absentee ballot leverage. Your power-broker friends can fill them out. You simply feed them into the computer as necessary when your candidates fall behind.
21.Remember, you cannot fix all elections, only those relatively close.

A NATION DIVIDED?

America bestows choice - The People's Voice - national elections. From this cause is effected the future's direction.

So, why the national debate? There are decisions to make. All dependent upon Democracy's Fate. Contingent on the nation's good judgment, or volatility. Perhaps, picking regeneration of vitality? Imprudently, perhaps, our mortality?

Sometimes, Man triumphs by his integrity. However, History confirms he is his worst enemy. At variance, perpetual quarreling - disputes - disagreement. Democracy's clashing opinions - squabbling - heated arguments. But, remembering, in the end, all are fatalities of iniquity.

Certainly: Hatred is not Love. No goodness is ever born of badness. No longer the pursuit of happiness. Angry nations easily descend into madness. Reason forsaken is Emotion's orphan. Unsound decisions derive from passions . The predictable inevitability of tribulations. For irate voters' govern by unwise selections. Concluding in the wrong candidate's election.

Was it not true, in World War II? Was not democracy forsaken by the charming hate-filled few? Is our nation divided? Of course... nothing new. So, think, this day, by ballot, what you do; or, do not do.
As for America... divided? ... Be it, always at odds; but, always United.

TIME FOR POLITICAL ACTION: PLACING CULPABILITY WHERE IT BELONGS THOSE WHO DESTROYED OUR NATIONAL REPUTATION

I never judge ANOTHER without initially pointing the figure of fault unswervingly at myself. However, these perilous distressed times, demand guilt be exactly sited where it belongs. Laid at the feet of the liable Florida public officials;

WHO ARE POLITICALLY GUILTY AS ACCUSED: [1] Secretary of State Katherine Harris, [2] Secretary of Agriculture Bob (Mr. Nice Guy) Crawford (both sat on the state 2000 canvassing board), [3} Miami, Broward, Palm Beach (and many other) county election supervisors. [4] Both Houses of Florida’s arrogant state legislature; [5] and; yes Governor Jeb Bush --- who can no longer assert ignorance or innocence. He realized precisely what was transpiring --- if not being its mastermind.

[6] The United States Supreme Court Justices (The Gang of Five) principally SCALIA and Rehnquist. Who nonchalantly just selected our President—by rejecting a complete vote count. What the Supreme Court did was: invalidate YOUR VOTE, MY VOTE AND EVERY OTHER AMERICANS VOTE. Candidly, since WE possess no vote---WE THE PEOPLE ARE --- NULLIFIED --- NO LONGER AMERICAN Citizens!!! IT WAS NOT ALWAYS LIKE THAT, WHY THE INTENSITY OF CURRENT HATRED???

There are numerous reasons… However, America has never been so despised in the world. Why??? In the past, commentators blamed much of this upon [1] economic jealousy [covetousness]; and, in our heart of hearts, no one really loves the Boss. However, presently there exists a novel strident international attitudinal change. Unbelievably, the primary rationale for this vituperative detestation is the 2000 election fiasco. Yes, it received, very little objection and media coverage at home. Not so in the remainder of the planet. Anyone residing overseas, who stays abreast international news coverage, soon recognized the devastating humiliation, disgrace, shame and defamation caused our national reputation. The world community was bewildered which soon was transformed into loathing, disrespect, and revulsion. Throughout Planet Earth we are called “That Hypocrite America. They talk democracy, but they are just like us--- a phony wherein the wealthy interests fix and subtly manipulate the electoral process to their economic benefit at the public’s expense.” Obviously, entire world perceived the 2000 election as a fix. Particularly, since Gore (who I did not enthusiastically support) triumphed in the popular vote; nonetheless was declared the loser by an egotistical unelected US Supreme Court. Because you can appropriate just about anything from people and they will simply get the police and attempt to imprison the thief. However if you steal peoples’ HOPE as they barely survive desperate lives; first, they will be hurt, then become incensed and eventually ferociously attack you. The downtrodden subsist on a handful of rice and HOPE, DREAMING someday they will be a liberated democracy; and, perhaps enjoy the prosperity of the American Dream. Election 2000 shattered that indispensable fundamental illusion persuading the world the US was a liar and hypocrite regarding democracy.

In addition, if there is one thing people hate---it is a hypocrite, who promises one thing but does the opposite. We must redeem ourselves in the world’s eyes. My European friends would criticize America, “Boy you American’s are so stupid you always hang-up your dirty laundry for the whole world to see.” My reply was “That is what a democracy is supposed to do. Find the corrupted, polluted bed linens; hang them up for the world to see. Then take down the filth --- wash it, bleach it bright white; and, then re-hang it! To illustrate to the world we are a constantly transforming republican-democracy------

We are not like you European dummies, who sweep everything under the rug, until a plague or another war breaks out. More to the point, THAT IS WHY WE named OUR NATION’S CAPITAL “WASHING-TON!” THE FOLLOWING EXCERPTS FROM ESSAYS WERE WRITTEN I That’s why Bush traveled to Russia for nuclear weapons reduction, However, most importantly, to assure Russia we will be their future Ally and join them to NATO.
